Certificates of Compliance

A Certificate of Compliance is required for all new build work and for any alteration, addition or extension work to an existing property to ensure that all works have been carried out in accordance with any planning permission granted and the Building Regulations.

Our Certificates of Compliance are prepared in accordance with the formats recommended by the Law Society of Ireland Conveyancing Handbook.

Opinions of Compliance fulfil the same function as a Certificate of Compliance, however, are provided following completion of the building works. As part of our Pre-Purchase Surveys, we identify where Certificates of Compliance with the Building / Planning Regulations will be required to be produced by the Vendor of the property.

Typical alterations that require certification with building and planning regulations:

  1. Any rear extension – most are planning exempt but the regulations are very specific. A site inspection is always require to confirm ‘exempted development’ status. Certification with building regulations is required for any works carried out after the 1st June 1992, however, transitional arrangements also apply.
  2. Structural alterations such as the removal of load-bearing walls and attic conversions. Compliance with Part (A) Structure of the Building Regulations will be required. As such works are considered an ‘improvement’ to a residential dwelling, planning is not required.
  3. Side Extensions: planning permission must be obtained for works forward of the rear building line.
  4. Any alterations substantially affecting the appearance of a property.
